1. Acceptance

By accessing VirtualSun (“the Site”) you agree to these terms. If you do not agree, please do not use the Site. These terms may be updated at any time; the version published here is the version in force, and continuing to use the Site after a change constitutes acceptance of it.

2. No investment advice, no adviser relationship

All content on the Site — including scores, signals, labels, rankings, charts, indicators, summaries, and aggregated headlines — is provided for general informational and educational purposes only. It is not investment advice, financial advice, trading advice, tax advice, legal advice, or a recommendation, offer, or solicitation to buy, sell, or hold any security, digital asset, or other financial instrument.

Nothing on the Site is tailored to your objectives, financial situation, or needs. VirtualSun is not a broker-dealer, investment adviser, financial planner, or fiduciary, is not registered with or licensed by any financial regulator, and no advisory, fiduciary, or professional relationship is created by your use of the Site. You should obtain independent advice from a licensed professional before making any financial decision.

3. Risk

All investment involves risk, including the total loss of capital. Past performance does not indicate future results. Digital assets in particular are highly volatile, may be thinly traded, are subject to inconsistent and changing regulation, and may lose all value. Exchange-traded funds carry the risks of their underlying holdings, along with costs and tax consequences that are not reflected in any figure on this Site.

The Site’s scores are derived exclusively from historical price and volume data. They are descriptive statistics about what has already occurred and have no predictive validity. They have not been backtested, and no representation is made that acting on them produces any result.

4. Third-party data and content

Market data is supplied by third parties, is cached, may be delayed, and — for funds — consists of end-of-day closing prices rather than live quotes. VirtualSun does not create, verify, guarantee, or endorse this data and is not responsible for its accuracy, completeness, or availability. Providers are named on the data sources page.

Headlines are aggregated from publishers’ own public feeds and link to the publishers’ sites. VirtualSun does not endorse, adopt, verify, or take responsibility for the content of any linked article or external site, and inclusion of a feed is not an endorsement of its publisher.

5. No warranty

The Site is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or freedom from error. No warranty is given that the Site will be available at any particular time, that defects will be corrected, or that any figure displayed is correct.

6. Limitation of liability

To the maximum extent permitted by applicable law, VirtualSun and anyone associated with it shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any trading or investment loss, loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of, or inability to use, the Site — whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not the possibility of such damages was advised.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is the case, the above exclusions apply only to the extent permitted, and nothing in these terms limits liability for fraud or for death or personal injury caused by negligence.

7. Acceptable use

You may read the Site, use it for your own research, and link to it. You may not:

• make automated requests at a rate that degrades the Site for others, or run scanners, crawlers, or load-testing tools against it;
• attempt to gain unauthorised access to the Site, its host, or its data, or probe or test its security other than as described on the contact page;
• redistribute the Site’s output commercially, or present it as your own or as the output of a licensed advisory service;
• scrape and republish third-party data obtained through the Site in breach of the original provider’s terms;
• use the Site in a way that breaks any applicable law or regulation.

8. Intellectual property

The VirtualSun name, logo, page designs, written text, and scoring implementation are the property of their owner. Market data, ticker symbols, fund names, publication names, headlines, and trademarks belong to their respective owners and are used for identification and attribution only. VirtualSun is not affiliated with, endorsed by, or sponsored by any data provider, publisher, issuer, or exchange.

9. No advertising or paid placement

The Site carries no advertising, sponsored content, affiliate links, or paid placement. No party pays to be listed, to be ranked, or to be scored in any particular way, and no ranking on this Site can be purchased.

10. Availability and changes

The Site may be modified, suspended, or discontinued at any time without notice. Features, universes, factor weights, and data providers may change. There is no obligation to maintain the Site, to preserve any figure it has previously displayed, or to notify you of any change.

11. Governing law

These terms are governed by the laws of the operator’s place of residence, without regard to conflict-of-law rules, and the courts of that jurisdiction shall have exclusive jurisdiction over any dispute. Nothing in this clause removes any non-waivable right you have as a consumer under the law of your own country of residence.

12. Severability

If any provision of these terms is found unenforceable, that provision shall be limited or removed to the minimum extent necessary and the remaining provisions shall stay in full force.
